Member T&Cs: Text

1. Membership

1.1. Helper and Non-helper Memberships will be either 6 months or 12 months from the date of registration.
1.2. Membership is not transferable, but can be deferred or refunded at the Committee’s discretion.
1.3. Members are responsible for notifying the Librarian of any changes to their registration details (address, telephone number, email).
1.4. Membership may be cancelled at the discretion of the Committee.
1.5. New memberships must be paid prior to any toys being issued.
1.6. Annual membership renewal that has not been paid within one month of the due date will be assumed to have resigned as a member of the Library. Such a member will not however be released from unpaid fines or other fees.

2. Toy Library Sessions

2.1. Session Times: Saturdays, Fortnightly 09:30AM – 11:30AM
Please supervise your children at all times.
2.2. The Library is closed on public holidays, and occasionally the Saturday of long weekends.  We also close for approximately two to six weeks during the December/January holidays depending on volunteer availability.
2.3. Please check the SETLs Calendar, the Waiheke Toy Library Facebook page and the website for opening and closing dates. We endeavour to give plenty of notice for all closures.

3. Helper Roster (for Helper Members only)

3.1. Members who choose Helper membership will be expected to assist with one opening hours session or one fundraiser every 6 months. 
3.2. Rosters will be updated fortnightly on the Facebook page. The shift is from 09:15AM – 11:45AM. 
3.3. Helper Members on duty are expected to help with tasks such as counting toy pieces, updating SETLs & labels with missing items & filling in the missing piece reports online, cleaning toys & bags & putting them back on the shelves. And any general tidying, cleaning, sorting, helping with returns as directed by the Librarian.
3.4. Helpers may find it easier to do duty without their children present. However, we welcome you to bring your child/children along so long as you manage to get all required tasks done (even if that means staying longer than the opening time). Of course, we also trust your judgement call on whether your child/children will be able to last the full session if you choose to bring them along.
3.5. Helper Members who are unable to do their rostered day for any reason must let the Librarian know as soon as possible either by phone or email.
3.6. In order to be eligible for the 50% party discounts offered to Helper Members, a volunteer session must be worked prior to date of hire. If it is not possible to do so, at least a nomination in the calendar for a date must be made, and if the Helper Member does not work that shift which occurs after the hire event, they are required to pay the difference of their hire so it is charged at a Regular Member rate.
3.6. If the required helping duties have not been completed by the end of the Membership period, the member will be required to pay $55.00 if they are on a 6 month membership, or $60 if they are on a 12 month membership (this is a pro-rated fee for the difference between a rostered membership and a full fee membership). Failure to pay this will put a block on your account & the Member will not be able to loan toys/renew memberships until this is paid or the duties are fulfilled.

4. Health, Hygiene & Cleaning

4.1. Please do not bring sick children into the Toy Library.  If the Librarian cannot work because of sickness, and a replacement cannot be found, the Library may be closed at short notice. Last minute closures will be posted on our Facebook page and an email sent out to all members.
4.2. We ask that all members clean the toys before returning them to the Library, and that extra vigilance is taken if children have been sick as viruses can live on hard surfaces for a few days. 
4.3. It is our aim to provide and promote the safe use of toys.  Please let us know of any safety concerns you may have about a toy.  The Toy Library is not responsible for any damage to person or property caused during the use of Toy Library property.

6. Safety

6.1. Waiheke Toy Library ("Provider") is pleased to make bicycles and scooters available to subscribers ("the Service"). As a subscriber to the Service you acknowledge that there are dangers and risks inherent with bicycle and scooter riding (the “Activity”) to which any child under your supervision ("Your Child") may be exposed. The Provider does not provide protective clothing or bicycle helmets and it is your responsibility to ensure that Your Child wears a helmet at all times and is otherwise appropriately attired when participating in the Activity. You agree that Your Child will participate in the Activity at your own risk. You also agree to voluntarily assume responsibility for supervising the Activity and any injury, death or property damage you or Your Child may suffer or cause as a result of participating in the Activity. To the maximum extent possible at law, you (both in your personal capacity and on behalf of Your Child) agree to release, hold harmless and indemnify the Provider and its respective officers, employees, servants, agents and contractors (the “Indemnified Persons”) against all actions, claims, suits, costs, expenses, demands and damages suffered or incurred by the Indemnified Persons or any one or more of them by reason of, or in respect of, or in any manner whatsoever arising out of, or caused by, your use of the Service or Your Child's participation in the Activity. You agree that you are subscribing to the Service on the express condition that the Provider: (a) will, under no circumstances be liable or responsible in any manner whatsoever for any death, loss, accident, damage or injury to you, Your Child or any of your servants, agents, contractors, visitors or invitees or any other person whatsoever (“Related Party”) which may happen as a result of your use of the Service or Your Child participating in the Activity; and (b) will not incur or be under any liability whatsoever to you, Your Child, or to any Related Party for any loss, damage or injury to or in respect of any of your property or of any Related Party’s property. The Provider is not liable to you, Your Child or any Related Party in respect of any indirect or consequential loss. For the avoidance of doubt, ‘consequential loss’ means loss or damage arising from a breach of contract, tort (including negligence), under statute or any other basis in law or equity of an indirect or consequential nature including, but without limitation, loss of profits, loss of revenue, loss or denial of opportunity, loss of goodwill, loss of business reputation, future reputation or publicity, damage to credit rating and indirect, remote, abnormal or unforeseeable loss, or any similar loss whether or not in the reasonable contemplation of the parties.

7. Returning Toys

7.1. All toys must be returned clean, undamaged, and with all pieces including the boxes, bags and instructions, present
7.2. When returning toys, members are asked to remain with their toys and help the Librarian/Duty Helper Member/Volunteer to count the pieces being returned
7.3. Toys returned two weeks (one session missed) overdue will incur a fine of $2 per fortnight per toy until the toys/s are returned
7.4. Toys must be cleaned & dried before they are returned. If a toy is returned in a dirty condition the toy will be re-issued for another two weeks in order for it to be taken back home to be cleaned or the Librarian will ask for the toy to be cleaned by the Member returning the toy whilst at the container shop
7.6. Batteries are not always provided in battery operated toys.  Members may supply their own batteries and on returning the toy to the Library, are entitled to remove the batteries they supplied or may donate the batteries by leaving them in the toy. However, being a nonprofit organisation, we would appreciate any good batteries left with us!
7.7. Members who are unable to return their toys by the due date must renew them via their online profile, if the maximum number of renewals has been reached and a member knows they still won't be able to make it to an open session, they must let the Library know immediately in case there are any holds or reservations on the toy, we are a community service and will do what we can to help our members vs penalise them, but also bear in mind that other kids are missing out on their turn to hire the toys that are returned late.

8. Missing Pieces / Lost Toys

8.1. If a piece of a toy is missing, the toy will be re-issued to the member for another two weeks in order that they find the missing piece
8.2. If the piece cannot be found, and it is not integral to the operation of the toy, a fine of $5 per missing piece will be payable.  However if the replacement cost of this piece exceeds $5 then the member will be charged accordingly.  The fine is refundable should the piece subsequently be returned before purchase of a replacement.
8.3. If the piece cannot be found, and it is integral to the operation of the toy, the member will be charged the full replacement cost of the toy as assessed by the Toy Library Committee

9. Broken / Damaged Toys and Packaging

9.1. An appropriate fine at the Committee's discretion will be charged for any missing or badly damaged pieces. If a toy has been rendered unusable, and is a popular or rare toy, then the member will be charged the full replacement cost of the toy as assessed by the Toy Library Committee.
9.2. The Toy Library Committee may use their discretion with regards to fines for broken or damaged toys that are getting old, as over time naturally they will start to show signs of wear and tear when being used. If you notice that a part of a toy is starting to break or wear please let the Librarian know.

10. Fines

10.1. Fines for overdue, missing, and broken toys must be paid within one month of incurring the fine. Failure to do so will result in suspension of membership and the member will be unable to take out any further toys until the outstanding fine is paid.
